FAMILY BASED VISAS

This category of visas is for United States citizens and permanent residents that desire to bring other family members to live in the United States.  The types of visas which fit within this category are as follows:

NON-IMMIGRANT VISAS

• K-1 Fiancee Visa.
• K-3 Spousal Visa.

IMMIGRANT VISAS: Visas for children or the spouse of an American citizen.

• First Preference:  sons and daughters who are single adults, over 21 years of age, and a citizen of the United States. 
• Second Preference:  A spouse, or children less than 21 years old.  The single sons and daughters, over 21 years of age, of a permanent legal resident.
• Third Preference:  Married children of a United States citizen.
• Fourth Preference:  Brothers and sisters of an American citizen and adopted children.

IMMIGRANT VISAS

An immigrant visa allows a person to stay permanently in the United States.  Once the immigrant visa is approved, the person can petition to become a permanent resident.  In most cases, after being a permanent resident for a minimum of five years, a person can petition to become a United States citizen.
